1. Who this is between
This is an agreement between ConstruC (San Francisco, California, United States) and the firm whose account is created on tryconstruc.com. Whoever creates the firm confirms they are authorised to accept these terms for it.
2. What we provide
Access to the ConstruC platform: drawings and RFIs, quantity takeoff and billing, procurement, site records, finance, equipment and programme management, together with the assistant. We may add, change or retire features; if we retire something your firm depends on, we will give notice rather than remove it under you.
3. Your data is yours
Everything your firm puts in — drawings, bills, ledgers, site records — remains your firm's property. We claim no ownership and no licence beyond what is needed to run the service for you. You can export it, and you can ask us to delete it. See the privacy notice.
4. Your responsibilities
- Keep sign-in credentials secure, and remove people who leave your firm.
- Only upload material your firm has the right to upload.
- Do not attempt to reach another firm's data, probe the service for weaknesses without asking us first, or resell access.
- Use the outputs with judgement. ConstruC computes takeoff quantities, rates, forecasts and tax figures from what you give it — they are a professional tool, not a substitute for a professional's sign-off.
5. The assistant
The assistant answers under the asker's own permissions and proposes every write for confirmation before it happens. It can still be wrong. Check anything consequential — a valuation, a tax figure, a programme date — before acting on it.
6. Availability
We work to keep ConstruC available and we take backups, but we do not currently offer a contractual uptime guarantee. Planned maintenance is announced in advance where we can. If your firm needs a formal SLA, talk to us.
7. Fees
Where a paid plan applies, the price, billing period and currency are those agreed with your firm in writing. We will not change a price mid-term without telling you first. Unpaid accounts may be suspended after notice; we will not delete your data without giving you a chance to export it.
8. Ending it
Your firm can stop using ConstruC at any time and ask for an export and deletion. We may end an account for a serious or repeated breach of these terms, with notice and an opportunity to fix it except where the breach is causing harm.
9. Liability
To the extent the law allows, our total liability in any twelve-month period is limited to the fees your firm paid us in that period, and neither side is liable for indirect or consequential loss. Nothing here limits liability that cannot be limited by law.
10. Governing law
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules, and the state and federal courts located in San Francisco, California have exclusive jurisdiction. If a dispute arises, we would much rather you emailed info@tryconstruc.com first.
11. Changes
If these terms change materially we will tell account owners by email. Carrying on using ConstruC after that means accepting the new version.
