These Terms of Service (“Terms”) govern your access to and use of the ConstruC platform, including our website, mobile applications, and all related services (collectively, the “Service”), operated by ConstruC Inc. (“ConstruC,” “we,” “us,” or “our”).
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. You must be at least 18 years of age to use ConstruC.
To use the Service, you must create an account with accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Each account is for a single individual; sharing login credentials is prohibited.
If you create an account on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
ConstruC offers the following plans:
Billing: Subscriptions are billed on a recurring monthly or annual basis through Stripe. Your payment method will be automatically charged at the start of each billing cycle unless you cancel at least 24 hours before the renewal date.
Free trial: The Pro plan includes a 14-day free trial. Your payment method is captured at signup but will not be charged until the trial ends. You may cancel at any time during the trial without being charged.
Who pays: Only the person who creates a project or organization needs a paid plan. Team members who are invited to a project use the creator’s plan at no additional cost.
Price changes: We may change our prices with at least 30 days’ advance notice via email. Continued use after a price change constitutes acceptance of the new pricing.
Refunds: Payments are non-refundable except where required by applicable law or where ConstruC terminates your account without cause.
You agree not to:
We reserve the right to suspend or terminate accounts that violate these terms.
You own your data. You retain all rights, title, and interest in all Project Data that you or your team upload, create, or store on the platform. ConstruC does not claim ownership of your content.
You grant ConstruC a limited, non-exclusive license to use your Project Data solely for the purpose of providing, maintaining, and improving the Service. This license terminates when you delete your data or close your account.
We will never sell, share, or use your Project Data for advertising purposes. ConstruC Intelligence (our AI features) processes your data only within your project scope and does not share information across projects or customers.
Your data is stored on secure, encrypted cloud infrastructure. We implement industry-standard security measures including:
While we take reasonable precautions to protect your data, no method of electronic storage or transmission is 100% secure. We cannot guarantee absolute security.
ConstruC performs regular automated system backups. In addition, project administrators may request recurring data backups delivered on a schedule of their choosing (monthly, bi-monthly, or quarterly). Backup requests can be configured in project settings or by contacting support.
Project administrators may export their project data at any time through the platform. Upon termination of your account, you will have 30 days to export your data before it is permanently deleted.
We use commercially reasonable efforts to maintain the availability of the Service. However, the Service is provided on an “as available” basis, and we do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible.
ConstruC and its licensors retain all rights, title, and interest in the Service, including all software, design, branding, logos, and documentation. These Terms do not grant you any rights to use our trademarks or branding without prior written consent.
You retain ownership of your Project Data (see Section 6). If you submit feedback, suggestions, or feature requests, you grant ConstruC a perpetual, worldwide, royalty-free license to use that feedback to improve the Service without obligation to you.
The Service integrates with third-party providers to deliver certain functionality, including payment processing, email delivery, and AI-powered features. These third-party services are governed by their own terms and privacy policies. ConstruC is not responsible for the availability or actions of third-party services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONSTRUC’S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO CONSTRUC IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
CONSTRUC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
Construction disclaimer: ConstruC is a project management and collaboration tool. It is not a substitute for professional engineering, architectural, legal, or safety judgment. Decisions affecting the safety, structural integrity, or legal compliance of a construction project must be made by qualified licensed professionals. ConstruC bears no responsibility for construction outcomes based on data managed through the platform.
By you: You may cancel your subscription at any time through the billing page in your account settings. Your access will continue until the end of your current billing period. After cancellation, you will have 30 days to export your data.
By ConstruC: We may suspend or terminate your account if you violate these Terms, fail to pay fees when due, or engage in activity that threatens the security or integrity of the Service. We will provide reasonable notice when possible.
Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days to allow export, after which it will be permanently deleted.
Governing law: These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles.
Informal resolution: Before initiating any formal dispute, you agree to contact us at info@tryconstruc.com and attempt to resolve the matter through good-faith negotiation for at least 30 days.
Arbitration: If informal resolution fails, any dispute shall be resolved through binding arbitration administered in San Francisco, California. You agree to resolve disputes individually and waive any right to participate in a class action.
We may update these Terms from time to time. For material changes, we will notify you at least 30 days in advance via the email address associated with your account. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
